Liminal — Terms of Service
These Terms of Service ("Terms") are a legal agreement between you ("you" or "User") and ProgramU LLC, a Wyoming limited liability company ("ProgramU," "we," "us," or "our"). These Terms govern your access to and use of the Liminal mobile application and any related services (collectively, the "Service").
By accessing or using Liminal, you agree to be bound by these Terms. If you do not agree, do not use the Service.
If you have questions, reach out at support@programu.app.
1. Who Can Use Liminal
Where Liminal Is Available:
Liminal is offered in the countries where it is available on the App Store or Google Play (the "Supported Countries"). It is not offered in mainland China, Russia, or countries and regions subject to comprehensive United States sanctions, and it may not be available in some other countries. By using Liminal, you confirm that you live in a Supported Country. If you live outside the United States, Section 20 (Country-Specific Terms) also applies to you, and it controls where it differs from the rest of these Terms.
Age Requirement:
Liminal is intended for adults 18 years of age and older. By using Liminal, you represent and warrant that you are at least 18 years old, or the age of majority where you live if that is higher (for example, 19 in some Canadian provinces and territories). You confirm your age when you accept these Terms at consent.
Account Registration:
Liminal starts without an account; you can add an email address, or sign in with Apple or Google, so that your journal survives a lost phone. You agree to provide accurate information, keep your login credentials confidential, take responsibility for all activity under your account, and notify us at support@programu.app immediately if you suspect unauthorized access.
ProgramU LLC is not liable for any losses resulting from unauthorized account access caused by your failure to keep your credentials secure.
Sanctions and Local Laws:
You may not use Liminal if you are located in, or ordinarily resident in, a country or region subject to comprehensive United States sanctions, or if you are on a United States government list of prohibited or restricted parties. You are responsible for following the laws that apply to you where you use Liminal.
2. Important Disclaimers — Read Before Using
Liminal is a wellness and self-exploration tool. Before using the Service, you should understand the following important limitations:
• Not Medical or Mental Health Care. Liminal is NOT therapy, medical care, mental health treatment, or a substitute for any of those. Liminal is not a medical device or diagnostic tool, and it does not diagnose, treat, cure or prevent any condition, including sleep disorders. If you have or suspect a sleep disorder (such as insomnia, sleep apnea or narcolepsy), experience sleep paralysis that distresses you, or have a condition affected by sleep (such as epilepsy or a seizure disorder), consult a qualified professional before using sleep or brainwave audio.
• Not Professional Advice. Liminal content does NOT constitute medical advice, mental health advice, financial advice, legal advice, or professional counseling. Always consult qualified professionals for matters requiring expert guidance.
• Not an Emergency Service. Nobody at ProgramU watches your conversations as they happen, Kairos cannot call anyone or send help, and our automatic safety checks can miss things. If you or someone else is in danger, call your local emergency number. The Get Help screen lists free crisis lines for your country.
• No Professional Relationship. Using Liminal, including talking with Kairos, does not create a therapist-client, doctor-patient, counselor, coach, fiduciary or any other professional relationship between you and ProgramU LLC.
• AI-Generated Content. Kairos's conversations, Liminal's dream titles, summaries, detected themes and readings, and some of Liminal's audio are produced by artificial intelligence (Google, Anthropic and Inworld AI models). AI can produce errors, inaccuracies, biases, or unintended outputs. Use your own judgment when applying anything Liminal says to your life.
• Safe Listening. Sleep and brainwave audio are made to be listened to in bed, at the edge of sleep. Do not listen while driving, operating machinery, or in any situation requiring alertness.
• Dream Practices Can Surface Difficult Material. Dreamwork, lucid-dreaming practice, and related techniques can surface intense emotions, memories, or experiences (including sleep paralysis and vivid or unsettling imagery). These are commonly reported aspects of the practice, but if they cause you distress, stop and seek support from a qualified professional.
• Results Vary. Lucid dreams, out-of-body experiences, and improved recall are practices, not products. Experiences described by other users, or by Liminal's own educational content, are theirs alone and are not typical, promised, or predictive of yours. Many nights, nothing happens; that is a normal part of the practice.
• Supported Countries Only. Liminal is offered only to people who live in the Supported Countries described in Section 1.
Full disclaimers and limitations are detailed throughout these Terms. By using the Service, you acknowledge these limitations.
3. What Liminal Is
Liminal is an AI-powered dream journal and sleep app. It offers instant dream capture (voice and text), automatic transcription, a dream archive with tagging and pattern detection, lucid-dreaming and related technique guides, brainwave and ambient sleep audio and a track mixer, reality-check and wake-back-to-bed reminders, optional sharing of chosen dreams with one linked partner, and Drift — real-time AI conversations about your dreams with Kairos, an AI specialist in dream decoding and lucid-dreaming technique.
Background dream intelligence (transcription, titles, summaries, themes and, when you ask for them, Kairos's written readings) runs on Google and Anthropic models. Kairos's live voice and text conversation is generated by a different provider: Google's Gemini model, reached through Inworld's routing infrastructure, with Inworld also providing speech-to-text and text-to-speech for voice calls. See Section 6.4 and Section 18 for the Drift AI details.
What Liminal is NOT:
• Not therapy, counseling, or mental-health treatment
• Not medical care, diagnosis, or a medical device
• Not a treatment for any sleep disorder
• Not an emergency service
• Not an oracle: Kairos says what she thinks a dream is doing and why, and hands it back — never the last word; your own read outranks hers. She does not predict the future, claim hidden knowledge, or provide advice
Technique content (lucid dreaming, out-of-body practices, and similar) is educational material describing practices people report; individual experiences vary, and no specific outcome is promised.
4. Subscriptions and Payments
Free and Premium:
Liminal's core journal is free. Liminal Premium (Kairos in the Drift, the full audio library, the programs and the readings) is a subscription. Pricing and what the subscription includes are always shown in the app before you buy.
Where You Can Buy:
Subscriptions are sold only through the Apple App Store (iOS) and Google Play (Android), which bill you and charge any sales tax that applies. Liminal has no web checkout.
Auto-Renewal:
Your subscription will automatically renew at the end of each billing period (monthly or annually) unless you cancel at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price unless we communicate a price change in advance.
Managing Your Subscription:
The mechanics of cancellation are governed by the platform on which you purchased:
• iOS: cancel via Settings → your Apple Account → Subscriptions
• Android: cancel via Google Play Store → Subscriptions
Free Trials:
If we offer a free trial, you will be charged at the standard subscription rate when the trial ends unless you cancel before the trial ends. Trial duration and conversion details are disclosed at signup. Free trials are limited to ONE per account and per person; if a free trial was previously used on your account (on either platform), a later purchase may proceed without a trial, billing immediately.
Free Features:
Features we offer without a subscription are offered at our discretion. We may change, limit or withdraw them at any time; a change does not remove your journal, which stays yours under Section 8.
Refunds:
• iOS refund requests are handled by Apple per Apple's policies. Contact Apple Support.
• Android refund requests are handled by Google per Google's policies. Contact Google Play Support.
• Nothing in this Section limits a refund or cancellation right that the law of the country where you live gives you and that cannot be excluded by contract (see Section 20).
Before You Dispute a Charge:
You agree to contact support@programu.app about any billing issue before initiating a card dispute, and to give us five business days to resolve it. Subscription records, in-app acceptance of these Terms, and service-delivery records constitute proof of authorization, and we contest unwarranted chargebacks with them.
Price Changes:
We may change subscription prices from time to time. Material price changes will be communicated at least 30 days in advance through the app or by email, and you may cancel before the new price takes effect.
Starting Right Away:
When you start a subscription, you ask us to make it available immediately. Where the law of your country provides a cancellation (cooling-off) period that ends once a service has started with your consent, that period ends when your subscription becomes available. This does not affect your rights if the Service is faulty.
5. License to Use Liminal
Subject to your compliance with these Terms, ProgramU LLC grants you a limited, non-exclusive, non-transferable, revocable license to use the Liminal app for your personal, non-commercial use.
You may not:
• Sublicense, sell, lease, or rent Liminal
• Reverse engineer, decompile, or disassemble the app
• Remove or alter any proprietary notices
• Use Liminal to develop a competing product
• Use Liminal in violation of any applicable law
• Bypass or attempt to bypass any access controls or content filters
This license terminates automatically if you violate these Terms.
6. AI-Generated Content and Usage Responsibility
§6.1 — AI-Generated Content
Liminal is an AI-powered tool. Dream transcriptions, titles, summaries and detected themes, Kairos's readings of a dream, the Sunday reflection, the Deep Read, drafted intentions, "about you" notes, readings of a night you and a linked partner both dreamed, and everything Kairos says in the Drift are produced by artificial intelligence models, including (without limitation) models from Google, Anthropic and Inworld. Background intelligence and written readings are generated by Google's and Anthropic's models; Kairos's live voice and text conversation is generated by Google's Gemini model via Inworld's routing infrastructure (and, if that model is unavailable, a comparable model Inworld's router may automatically substitute); voice synthesis and speech-to-text are provided by Inworld. See Section 6.4 and Section 18.
AI systems can produce errors, biases, inaccuracies, and unintended outputs despite our content filters, safety boundaries, and ongoing refinement. The quality, accuracy, suitability, and effectiveness of any individual AI output is not guaranteed.
Streaks, counts and pattern numbers are computed by our servers from your own data, never invented by the model; treat everything else the AI says as fallible reflection, not fact or advice.
Liminal is continuously refining the system. The AI models, prompts, content filters, and underlying configurations evolve over time. Content generated today may differ from content generated tomorrow as Liminal improves. You acknowledge that AI-generated content is inherent to the service and that variability is not a defect.
Without limiting the foregoing: ProgramU is not liable for any reliance you place on AI-generated content, including but not limited to readings, summaries, conversations with Kairos, or any other content delivered through the Service.
§6.2 — Usage Responsibility (Safe Listening)
You are solely responsible for choosing when and where to use Liminal. For sleep audio, brainwave tracks, and any guided or relaxation experience:
(a) You will not listen while driving any vehicle.
(b) You will not listen while operating machinery of any kind.
(c) You will not listen while exercising or performing any physical activity requiring full attention.
(d) You will not listen while performing any task where loss of alertness could endanger you or others (for example, cooking on an active stove, supervising children near water, walking in traffic).
(e) You will use sleep-oriented audio only when you are in a safe place and ready to sleep.
If you have epilepsy, a seizure disorder, or another condition that may be affected by rhythmic audio stimulation, consult a qualified professional before using brainwave audio.
ProgramU is not liable for any consequence — direct, indirect, incidental, consequential, special, or punitive — resulting from your use of the Service in inappropriate or unsafe contexts.
§6.3 — Not a Substitute for Professional Care
Liminal supports your own practice; it does not provide medical, psychiatric, psychological, legal, or financial advice, diagnosis, or treatment of any kind. Liminal's audio and readings are not medical interventions and are not designed to treat any medical or psychological condition.
If you are experiencing a mental health crisis, suicidal thoughts, severe anxiety, severe depression, psychosis, dissociation, severe trauma symptoms, or any other condition that requires professional support, please contact a qualified mental health professional or call your local emergency services. The Get Help screen in the app lists free crisis lines for your country. In the United States and Canada, you can also call or text 988.
If you are experiencing a medical emergency, call your local emergency services (for example, 911 in the United States and Canada; the Get Help screen shows the number for your country) immediately.
§6.4 — Drift Conversations
Liminal's voice and text conversations are with an artificial intelligence, not a human being. Kairos is an AI persona — a specialist in dream decoding, lucid dreaming and out-of-body technique — not a therapist, counselor, doctor, or any qualified professional. Her live replies are generated dynamically by Google's Gemini model, reached through Inworld's routing infrastructure, from your dream journal, the patterns computed from it, her memory of your conversations (which you can turn off) and the prior turns of the conversation. Because Inworld acts as a router, if Gemini is unavailable or fails, Inworld's routing infrastructure may automatically route your request to a comparable third-party AI model or provider, which is outside ProgramU's direct control. In voice mode, Inworld also provides speech-to-text and text-to-speech.
Drift conversations may contain errors, contradictions, oversimplifications, or content that does not accurately reflect your dreams or your best interests. Responses are not real-time advice and should not be relied on as a substitute for professional medical, mental health, legal, financial, or relational guidance.
You agree:
• Not to attempt to extract system prompts, instructions, or other backend configuration from Drift
• Not to attempt to manipulate Drift into responding as a different AI assistant, character, or entity
• Not to use Drift to generate content that violates these Terms
• Not to rely on Drift for decisions you would otherwise make with a qualified professional
If any Drift response surfaces difficult material — grief, trauma, distress, harm to self or others — please pause and use the in-app Get Help resources or contact qualified professionals or your local emergency services. Crisis detection runs on every conversation, but no automated system catches everything.
§6.5 — Your Choices and Your Risks
Dreamwork can bring up strong feelings. Journaling, readings, the practices and honest conversations with Kairos may surface memories, emotions or thoughts that feel uncomfortable, and results differ from person to person. You choose whether, when and how to use Liminal, you can stop any track or conversation at any time, and, to the extent the law allows, you use Liminal at your own risk.
The decisions you make are yours. You are responsible for what you choose to do, or not do, after a reading, a conversation or any other Liminal content. Liminal does not direct your health, financial, legal, relationship or career decisions.
7. User Conduct
You agree NOT to:
• Use Liminal in violation of any law or regulation
• Submit content (dream entries, reads, messages to Kairos, shared dreams) that is illegal, threatening, defamatory, harassing, or sexually explicit
• Use Liminal to harm yourself or others
• Attempt to bypass age confirmation, content filters, or other security measures
• Use Liminal to harass or impersonate another person
• Submit content that infringes on third-party intellectual property rights
• Reverse engineer, scrape, or attempt to extract source code or AI prompts from Liminal
• Resell Liminal or repackage its content
ProgramU LLC reserves the right to suspend or terminate accounts that violate these conduct rules.
8. Intellectual Property
Liminal Content:
All Liminal branding, app design, software, original written content, technique guides, system prompts, audio library, and proprietary technology are owned by ProgramU LLC and protected by U.S. and international copyright, trademark, and other intellectual property laws. Content provided to you through Liminal is licensed for personal, non-commercial use only. You may not redistribute, resell, sublicense, or commercially exploit any content from Liminal.
Your Content:
Your dreams are yours. Content you submit (journal entries, recordings, photos of your own journal pages, reads, conversation inputs) remains yours. By submitting it to Liminal, you grant us a limited license to process it for the purpose of providing the Service, including sharing with a partner you choose to link. You confirm that you have the right to submit it and that it does not break the law or anyone else's rights.
Feedback:
If you provide feedback, suggestions, or feature requests, you grant ProgramU LLC a perpetual, royalty-free right to use that feedback to improve the Service without compensation or attribution.
Copyright Complaints:
If you believe content available through Liminal infringes your copyright, send a notice to support@programu.app with: the work you say is infringed; where the content appears in Liminal; your contact details; a statement, made in good faith, that the use is not authorized; a statement, under penalty of perjury, that your notice is accurate and that you are the owner or authorized to act for the owner; and your physical or electronic signature. We respond to complete notices, may remove or disable the content, and may close the accounts of repeat infringers.
9. Privacy and Data Handling
Your dream data is sensitive personal information, and we treat it that way. Key commitments:
• We do not sell or share your personal data with advertisers
• We do not train AI models on your data
• Your journal is never shared beyond the processing our Privacy Policy describes, and a partner sees only the dreams you choose to share
• You can delete your data and your account at any time
For full details, see the Liminal Privacy Policy in the app (Profile → Privacy Policy) or at liminal-dreams.web.app/privacy.
10. Account Termination
Termination by You:
You may stop using Liminal at any time. To delete your account and all associated data: Profile → Delete account, or email support@programu.app. Deleting your account cannot cancel a subscription bought through the App Store or Google Play; cancel it in your Apple or Google Play subscription settings first.
Termination by Us:
ProgramU LLC may suspend or terminate your account if you:
• Violate these Terms
• Engage in conduct prohibited under Section 7
• Fail to pay subscription fees (handled by Apple and Google billing systems)
• Attempt to harm the Service, other users, or ProgramU LLC
We may also pause or limit your access, or a feature such as Kairos, if we reasonably believe it is needed to protect you, another person or the Service, for example after repeated messages about harming someone. Where we can, we will tell you why and point you to support.
Upon termination, you lose access to your account and the content in it. Account deletion is permanent.
No Refund on Termination for Breach:
To the extent the law where you live allows, if we terminate your account for a violation of these Terms, you are not entitled to a refund of fees already paid.
Survival:
Sections relating to disclaimers, intellectual property, indemnification, limitation of liability, dispute resolution, and governing law survive termination.
11. Disclaimer of Warranties and Limitation of Liability
No Warranties:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, LIMINAL IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT LIMINAL WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, THAT AI-GENERATED CONTENT WILL BE ACCURATE OR SUITABLE FOR YOU, OR THAT ANY PARTICULAR RESULT WILL FOLLOW FROM USING IT.
Limits on Our Liability:
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
ProgramU LLC and its members, managers, officers, employees, contractors, agents, licensors and affiliates (the "ProgramU Parties") shall NOT be liable for:
• Any indirect, incidental, special, consequential, exemplary, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Personal injury or emotional distress, except where caused by gross negligence or willful misconduct
• Damages arising from AI-generated content (including readings, conversations with Kairos and sleep audio) or your reliance on it
• Damages arising from your use of sleep or brainwave audio in unsafe contexts
• Damages arising from third-party services (Apple, Google, Google Firebase, Inworld AI, Anthropic, Expo, Sentry, Resend, RevenueCat, and other sub-processors)
IN NO EVENT SHALL PROGRAMU LLC'S TOTAL LIABILITY EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID PROGRAMU LLC IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow certain liability limitations, in which case the above limitations apply to the fullest extent permitted by law.
If you live outside the United States, the law of your country may not allow some of these limitations. Section 20 explains how they apply to you. Nothing in these Terms excludes or limits liability that cannot be excluded or limited under the law that applies to you.
No Personal Liability:
Liminal is provided by ProgramU LLC. To the maximum extent permitted by applicable law, no claim arising out of or relating to Liminal may be brought against its members, managers, founders, employees or contractors personally; your remedies lie against ProgramU LLC alone, subject to the limits in this Section.
Release:
To the maximum extent permitted by applicable law, you release the ProgramU Parties from all claims, demands and damages of every kind, known or unknown, arising out of or in any way connected with your use of Liminal, including the choices you make during or after a practice, a reading or a conversation with Kairos. If you live in California, you waive California Civil Code § 1542, which says: "A general release does not extend to claims that the creditor or releasing party does not know or suspect to exist in his or her favor at the time of executing the release and that, if known by him or her, would have materially affected his or her settlement with the debtor or released party." This release does not apply to claims that cannot be released under the law that applies to you, and Section 20 applies if you live outside the United States.
12. Indemnification
You agree to indemnify, defend, and hold harmless the ProgramU Parties (ProgramU LLC and its members, managers, officers, employees, contractors, agents, licensors and affiliates) from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney fees) arising from:
• Your use of Liminal
• Your violation of these Terms
• Your violation of any third-party rights (including intellectual property and privacy rights)
• Content you submit to Liminal, including dreams you share with a partner
• Any misuse of AI-generated content or any Liminal feature
13. Dispute Resolution and Arbitration
If you live outside the United States, this Section 13 does not apply to you. See Section 20.
Informal Resolution First:
Before initiating arbitration, you and ProgramU LLC agree to first attempt to resolve any dispute informally. The party raising the dispute must send a written Notice of Dispute to support@programu.app (or, from ProgramU LLC, to your account email) describing the nature of the claim and the relief sought. Both parties agree to negotiate in good faith for sixty (60) days from receipt of the notice. Arbitration may not be initiated before this period expires. This requirement is a condition precedent to arbitration, and the arbitrator shall dismiss without prejudice any demand filed before it is satisfied.
Mandatory Arbitration:
Any dispute, claim, or controversy arising out of or relating to Liminal, these Terms, or the relationship between you and ProgramU LLC shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
Location:
Arbitration shall take place in Sheridan, Wyoming, or by videoconference at the arbitrator's discretion.
Class Action Waiver:
YOU AND PROGRAMU LLC AGREE THAT ANY DISPUTE WILL BE RESOLVED ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE THE RIGHT TO PARTICIPATE AS A PLAINTIFF OR CLASS MEMBER IN ANY CLASS ACTION, COLLECTIVE ACTION, OR REPRESENTATIVE PROCEEDING.
Exceptions:
This arbitration clause does NOT prevent either party from:
• Seeking injunctive relief in court for intellectual property violations
• Pursuing claims in small claims court (where jurisdictionally appropriate)
Coordinated Filings:
If twenty-five (25) or more arbitration demands raising similar claims and sharing common or coordinated counsel are filed against ProgramU LLC, the demands shall be resolved in staged proceedings: they shall be grouped into batches of no more than twenty-five (25); a first batch selected by the parties (half by each side) shall proceed first, and all remaining batches — including associated filing-fee obligations — shall be stayed until the first batch concludes. The parties agree to meet and confer in good faith after each batch to explore global resolution. Any statute-of-limitations period is tolled for stayed demands from the date of filing. If this provision is held unenforceable as to a demand, that demand shall proceed individually under the remainder of this Section.
Time Limit on Claims:
To the extent permitted by applicable law, any claim arising out of or relating to Liminal or these Terms must be filed within one (1) year after the claim accrues; otherwise it is permanently barred. This does not shorten any non-waivable statutory period.
Jury Trial Waiver:
To the extent any dispute proceeds in court rather than arbitration (under the exceptions above), both parties knowingly and voluntarily waive any right to a trial by jury.
Opt-Out:
You may opt out of this arbitration agreement by sending written notice to support@programu.app within 30 days of first agreeing to these Terms. Opting out does not affect any other provisions of these Terms.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions. Any matters not subject to arbitration under Section 13 shall be brought exclusively in the state or federal courts located in Sheridan County, Wyoming, and you consent to the personal jurisdiction of those courts.
If you live outside the United States, this Section 14 does not apply to you. See Section 20.
15. Changes to These Terms
ProgramU LLC may revise these Terms from time to time. When we make material changes, we will:
1. Post the updated Terms in the app and at liminal-dreams.web.app/terms with a new "Last Updated" date
2. Notify you within the app
3. Require you to review and accept the updated Terms before continuing to use Liminal
For minor changes (such as typo fixes), we may update without requiring re-acceptance. The current version is always in the app at Profile → Terms of Service.
If you live in Quebec, we will send you a written notice at least 30 days before a change takes effect. It will set out the new or amended clause, the clause as it read before, and the date the change takes effect. If the change increases your obligations or reduces ours, you may refuse it and cancel your subscription without cost, penalty or cancellation indemnity by telling us within 30 days after the change takes effect.
16. Miscellaneous
Entire Agreement:
These Terms, together with the Privacy Policy and any other policies referenced, constitute the entire agreement between you and ProgramU LLC regarding Liminal, and supersede any prior agreements.
Severability:
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full effect.
No Waiver:
Failure by ProgramU LLC to enforce any right or provision does not constitute a waiver of that right.
Assignment:
You may not assign these Terms. ProgramU LLC may assign these Terms to a successor entity (for example, in connection with a merger, acquisition, or sale of assets) without notice.
Changes to the Service:
We may add, change, pause or remove features, content, models, voices and prices from time to time, and may discontinue the Service or part of it. Where a change materially reduces a paid subscription, you may cancel and, where the law of your country requires it, receive a pro-rated refund for the unused period. Your journal stays exportable from the app (Profile → Storage & export) for as long as the Service runs.
Electronic Notices:
You agree that we may give you notices in the app, by push notification or by email to the address on your account, and that these count as notices in writing where the law allows.
Force Majeure:
Neither party is liable for delays or failures caused by events beyond reasonable control (natural disasters, war, terrorism, internet outages, third-party service failures, and the like).
Apple App Store and Google Play Store compliance:
If you accessed Liminal through the Apple App Store, your use of Liminal on iOS is also subject to Apple's Media Services Terms and Conditions and the App Store's Standard EULA. Apple's terms govern your relationship with Apple regarding your iOS use of the app.
If you accessed Liminal through the Google Play Store, your use of Liminal on Android is also subject to Google Play's Terms of Service and Google's terms governing the Play Store. Google's terms govern your relationship with Google regarding your Android use of the app.
In-app purchases:
• iOS in-app purchases are processed by Apple under Apple's terms.
• Android in-app purchases are processed by Google under Google's terms.
You acknowledge that these Terms are between you and ProgramU LLC, NOT Apple or Google. Apple and Google have no obligation to provide maintenance or support services. Apple and Google are third-party beneficiaries of these Terms with the right to enforce them against you.
Apple-specific terms: If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you; to the maximum extent permitted by law, Apple has no other warranty obligation. ProgramU LLC, not Apple, is responsible for addressing any claim relating to the app or your use of it, including product liability claims, claims that the app fails to conform to a legal or regulatory requirement, consumer protection claims, and claims of intellectual property infringement, and for the investigation, defense, settlement and discharge of any third-party claim that the app infringes a third party's intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties. You must comply with applicable third-party terms (for example, your wireless carrier's terms) when using the app.
Language:
These Terms are available in English and in French. If you live in Quebec, the French version is offered to you first; you may then choose the English version, and the version you choose is the one that applies to you. If we translate these Terms into another language for convenience and the versions differ, the English version controls, except that the French version controls for a person in Quebec who chose it.

18. Drift — AI Conversations Disclosure
By starting a Drift conversation, you acknowledge the following.
You are talking to an AI, not a human. Kairos is an artificial intelligence persona — an AI designed as a specialist in dream decoding, lucid dreaming, and out-of-body technique. She is not a person, therapist, counselor, doctor, or any qualified professional, even when the conversation feels personal.
How live conversations are processed. Live voice conversations run on Inworld's realtime agent API: speech-to-text, a fast large language model (Google's Gemini) reached through Inworld's model router, and text-to-speech. Because Inworld operates a model router, if the primary model is unavailable a comparable model may be automatically substituted; this routing is outside ProgramU's direct control. By starting a conversation, you consent to your conversation content — and, in voice mode, your spoken audio — being transmitted to and processed by these providers. Your live audio is transmitted to Inworld only to be transcribed for the conversation; it is not used to create a voiceprint, is not used to train any model, and is not retained by ProgramU LLC. ProgramU does not currently have a Zero Data Retention agreement with Inworld or the routed model provider. Please review Inworld's privacy policy at inworld.ai/privacy, and see Section 13 of our Privacy Policy for the full Drift data flow.
Background AI. Dream transcription, titles, summaries, theme detection and — when you ask for them — Kairos's written readings, the Sunday reflection, the Deep Read and partner-night readings run after the fact (Google and Anthropic models), never inside your real-time conversation.
A read, never the last word. Kairos reads a dream through named ways of seeing and commits to what she thinks it is doing and why, then hands it back; your own read outranks hers, and her best material is your own record, not a symbol dictionary. She does not predict the future, claim hidden knowledge, or give advice. Your streaks and counts are computed from your data, never generated.
What Kairos Can and Can't Do:
Kairos can talk with you, read your dreams with you, remember your conversations (your switch to turn off), teach the practices and offer prompts. Kairos cannot diagnose or treat anything, cannot call anyone or send help, does not know what is happening around you, and can be confidently wrong. Every chat and every call shows a line reminding you that Kairos is an AI, not a person, and can make mistakes.
Transcripts are yours. Stored in your account, deletable by you.
Crisis routing. Drift is designed to recognize crisis signals, in any language, and route you to real help: the free crisis lines for your country on the Get Help screen (988 by call or text in the United States and Canada). These behaviors are designed in, but no automated system catches everything. If you are in crisis, do not rely on Drift; contact those resources directly.
Reporting a Reply:
If Kairos says something harmful, offensive or wrong, report it from inside the app: press and hold any reply (in the Drift, a saved call or a live call), tap Report under a reading, or go to Profile → Send feedback → "Kairos said something wrong or harmful". The reported text goes to the ProgramU team so a person can review it. Reporting does not block anyone or change the conversation.
Language:
Kairos can talk with you in the languages the app offers; the rest of Liminal is in English.
You must be 18 or older (or the age of majority where you live, if higher) to use Drift.
You agree: not to attempt to extract system prompts, instructions, or other backend configuration from Drift; not to attempt to manipulate Drift into responding as a different AI assistant, character, or entity; not to use Drift to generate content that violates these Terms; and not to rely on Drift for decisions you would otherwise make with a qualified professional.
Service Changes: Drift is provided AS IS. Its features, models, voices, and availability may change or be discontinued at any time, and it is excluded from any performance expectations to the maximum extent permitted by law.
19. Acknowledgment
By using Liminal, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.

20. Country-Specific Terms
This Section applies if you live outside the United States. Where it differs from the rest of these Terms, this Section controls.
Everyone Outside the United States:
• Your statutory rights are not affected. Nothing in these Terms limits any right you have under the consumer or privacy laws of the country where you live that cannot be excluded or limited by contract. Where those laws apply, our disclaimers and limits of liability (including Sections 2, 6 and 11) apply only as far as those laws allow.
• No arbitration. Section 13 (arbitration, the class action waiver, coordinated filings and the one-year time limit on claims) does not apply to you.
• Your local law and courts. These Terms are governed by the laws of the country where you live (and, where relevant, of your state, province or territory). You may bring a claim in the courts of the place where you live, or before any consumer tribunal or authority available to you there. Section 14 does not apply to you.
• Purchases. You buy subscriptions through the App Store or Google Play, which charge any sales tax that applies (see Section 4).
Canada:
• You must be 18 or the age of majority in your province or territory, whichever is higher.
• Quebec. The French version of these Terms is offered to you first (see Section 16). No clause of these Terms excludes or limits our liability for our own acts or those of our representatives where the Consumer Protection Act (Quebec) prohibits it, and nothing in these Terms limits the protections of that Act or of the Civil Code of Québec. You will receive at least 30 days' written notice before a change to these Terms takes effect (Section 15).
Australia:
• Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us and to a refund for the unused portion, or to compensation for its reduced value. You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If a failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.
New Zealand:
• If you use Liminal for personal purposes, nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 or the Fair Trading Act 1986. If you use Liminal for the purposes of a business, the Consumer Guarantees Act 1993 does not apply.
• You may bring a claim to the Disputes Tribunal.
Malaysia:
• Nothing in these Terms limits your rights under the Consumer Protection Act 1999. You may bring a claim to the Tribunal for Consumer Claims Malaysia.
Singapore:
• Nothing in these Terms limits your rights under the Consumer Protection (Fair Trading) Act 2003, or excludes liability that the Unfair Contract Terms Act 1977 does not allow to be excluded. You may bring a claim to the Small Claims Tribunals.
India:
• Nothing in these Terms limits your rights under the Consumer Protection Act, 2019. You may file a complaint with the Consumer Commission where you live or work.
• Grievance Officer: Zachary Fleshman, ProgramU LLC, 30 N Gould St Ste N, Sheridan, WY 82801, United States; privacy@programu.app. We acknowledge every complaint within 48 hours and resolve it within one month.
• In India, Liminal is sold only through the App Store and Google Play.
South Africa:
• Nothing in these Terms limits your rights under the Consumer Protection Act, 2008 or the Electronic Communications and Transactions Act, 2002. Sections 2, 6 and 11 contain terms that limit our liability or your rights; please read them carefully.
• Cooling-off. The 7-day cancellation right in section 44 of the Electronic Communications and Transactions Act does not apply once a service has started, with your consent, before the 7 days end. When you subscribe you ask us to start right away (Section 4), so the right ends when the Service starts. This does not affect your rights if the Service is faulty.
• Our details: ProgramU LLC, a Wyoming (United States) limited liability company; 30 N Gould St Ste N, Sheridan, WY 82801, United States; +1 615-669-4644; support@programu.app. Prices in the App Store and Google Play include the VAT they charge. Complaints: support@programu.app. You may also contact the National Consumer Commission or the Consumer Goods and Services Ombud.
Philippines:
• Nothing in these Terms limits your rights under the Consumer Act of the Philippines (Republic Act No. 7394) or the Internet Transactions Act of 2023 (Republic Act No. 11967). You may file a complaint with the Department of Trade and Industry.
European Economic Area, Switzerland and the United Kingdom:
• You have a legal guarantee that the Service and your digital content will match these Terms; nothing in these Terms limits it.
• Right of withdrawal: you can usually cancel a purchase within 14 days. If you ask us to start a subscription right away (Section 4) and cancel within those 14 days, you may have to pay for the part you already used. Apple and Google handle refunds for purchases made through them.
• We are responsible for loss or damage you suffer that is a foreseeable result of our breaking these Terms or failing to use reasonable care and skill. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law of your country does not allow us to limit.
• You may bring a claim in the courts of the country where you live, or contact your national consumer authority.
By using Liminal, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
